Terms of Service

These Terms of Service (“Terms”) govern your use of the website at https://moonwhisper.games/ (the “Site”). The Site currently provides information about Moonwhisper Games and its upcoming MMORPG; it does not yet offer user accounts, downloadable game clients, or paid features. By accessing or using the Site, you agree to these Terms.

1. Who operates this Site

Moonwhisper Games is an independent game studio in the process of being formally incorporated in Germany. Until that incorporation is complete, the Site is temporarily owned and operated by:

IT-Klimt is currently the sole legal operator of the domain moonwhisper.games and this website, on a provisional basis, pending registration of the future Moonwhisper Games company. “Moonwhisper Games” is not yet an incorporated entity; it is a project currently developed under the sole legal responsibility of IT-Klimt. All rights in the Site and the “Moonwhisper Games” project — including all artwork, are, for the time being, held on this temporary basis (“all rights temporarily reserved”). Once Moonwhisper Games is registered, it will assume the Site and these Terms, and this document will be updated to name the new entity as operator and, where relevant, its other members.

2. Purpose of the Site

The Site is currently provided for informational purposes only — to present the Moonwhisper Games project, its development progress, and ways to get in touch with the team. It does not currently require registration and does not process any payments. If and when the Site begins offering accounts, a game client, or paid features, these Terms will be expanded accordingly and republished with a new “last updated” date.

The Site is currently available in English, German, Spanish, and Chinese. These Terms and our Privacy Policy are provided in English and German; the English version and the German version are each intended to be equally authoritative for readers in the respective language. Spanish and Chinese page content is provided for convenience and does not include separate legal texts — if in doubt, the English or German legal texts control.

3. Intellectual property

3.1 All content on the Site — including text, graphics, all artwork, illustrations, concept art, and character designs, and the Moonwhisper Games name and logo — is protected by copyright, trademark, or other intellectual property rights and belongs to us or our licensors. All rights to this artwork and content are reserved.

3.2 You may view and share pages of the Site for personal, non-commercial purposes (e.g., linking to it or sharing a screenshot). You may not otherwise copy, modify, redistribute, publicly display, create derivative works from, or commercially exploit any artwork or other Site content, or use our name, logo, or brand assets, without our prior written permission.

3.3 If you believe content on the Site infringes your copyright, please contact us using the details in Section 10.

4. Acceptable use

When using the Site, you agree not to:

  • attempt to gain unauthorized access to the Site, its underlying systems, or any non-public areas;
  • interfere with or disrupt the Site’s operation (e.g. through excessive automated requests, scraping, or attacks on availability);
  • use the Site to transmit unlawful, defamatory, or harmful content (for example via any contact form we may offer);
  • misrepresent your affiliation with Moonwhisper Games.

5. No warranty; availability

The Site is provided “as is” and “as available.” Because Moonwhisper Games and its MMORPG are under active development, information on the Site (including screenshots, described features, and timelines) may change without notice and does not constitute a binding promise about the final game. To the extent permitted by mandatory German law, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

The Site may link to third-party services (e.g. social media, Discord, or community platforms). We are not responsible for the content or privacy practices of external sites; please review their own terms and privacy policies.

7. Limitation of liability

7.1 We are liable without limitation for damages resulting from injury to life, body, or health, for intentional or grossly negligent conduct, and under mandatory statutory provisions (e.g. the Produkthaftungsgesetz), and for the breach of any guarantee we have expressly given.

7.2 For damages caused by ordinary negligence, we are liable only if we breach an essential contractual obligation (a “Kardinalpflicht” — an obligation whose fulfilment is essential to the proper use of the Site and on whose compliance you may regularly rely). In such cases, liability is limited to the foreseeable, typically occurring damage.

8. Governing law and jurisdiction

8.1 These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, mandatory consumer-protection provisions of your country of habitual residence remain unaffected.

8.2 We are neither obligated nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

9. Changes to these Terms

We may update these Terms as the Site and project evolve — in particular once Moonwhisper Games is formally incorporated, or once the Site begins offering accounts, a game client, or paid features. Updates will be posted on this page with a new “Last updated” date.

11. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be replaced by a valid one that most closely reflects its intended purpose.
